Engineer:

I was called to work as the Engineer on assignment (XXXX) – at (insert time)  in the (location and pool).  I operated said train from (location to location), performed all work associated with my assignment and was then ordered by (person who ordered you) to relieve Hours Of Service (HOS) train (train relieved) that was inside (location Fort Wayne or Cincinnati) terminal yard limits. I was transported by taxi to the (train relieved) and completed all work associated with that assignment inside (location Fort Wayne or Cincinnati) terminal yard limits.I was instructed to perform work that was not in connection with my assignment, (original train)- inside yard limits while yard jobs were on duty and employed as outlined above. Article 15 – Section 3, Incidental Work, outlines the work required while yard crews are on duty within yard limits. This assertion is also supported by Public Law Board 4975, Award 81, and First Division, Award 24856. Therefore, please allow one, 8 hour basic day.
