Penalty – Over 16 Hours in the Hotel

Engineers – If you are called on a make-up spot and not used within 16 hours after putting off duty at the away-from-home-terminal then you are due a basic day. You also must be used within 16 hours when deadheaded to the away-from-home-terminal on any spot. Includes Conductors. This does not apply to self-sustaining pools.

Article 4 Section 10 – when called on a make-up spot for a train.

Article 12 Section 2 (b) – when called to deadhead on any spot and not used within 16 hours.

Conductors

Article 25 Section 2 When deadheaded to the away-from-home-terminal on a make-up turn.


Example:

Allow 1 basic day account I was used on a make-up spot on the FN (Fort Wayne to Cincinnati) Pool and was not used within 16 hours after putting off duty at the away-from-home-terminal in Cincinnati, Ohio.

The claimant worked train ***L0** and was put off duty on 3/13/17 at 11:41 AM.

The claimant was not called for duty until 9:30 AM on 3/14/17 on train ***L0**. Total time in the hotel was 21 hours and 49 minutes.

Violation of Article 4 Section 10 of the 1999 Agreement between Norfolk Southern and the Brotherhood of Locomotive Engineers and Trainmen.
